1. Agreement to Terms
By accessing or using CredPing (“the Service”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and CredPing. If you do not agree with any part of these Terms, you must not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
CredPing is a cloud-based software-as-a-service (SaaS) platform designed for Canadian trades businesses to track employee credentials, certifications, licences, and insurance. The Service includes credential management with document uploads, automated expiry notifications sent via email, team and organization management, a public compliance badge system (Live Badges) for sharing verification status with general contractors, and a progressive web application that works offline. The specific features available to you depend on your subscription plan.
3. Account Terms
To use CredPing, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Each account is intended for a single individual; sharing account credentials is not permitted. You must be at least 16 years of age to create an account and use the Service. Organization owners and administrators are responsible for the conduct of team members they invite to their organization. You must notify us immediately if you become aware of any unauthorized use of your account.
4. Subscription and Billing
CredPing offers a free tier with limited functionality and several paid subscription plans (Solo, Crew, and Fleet). Paid subscriptions are billed monthly or annually through our payment processor, Stripe. All prices are displayed in your local currency at checkout. We reserve the right to change subscription prices with at least 30 days’ written notice to affected subscribers. Price changes will not apply to your current billing period.
If you downgrade your plan, the change takes effect at the end of your current billing period. You will retain access to paid features until that date. For annual plans cancelled within 14 days of purchase, we offer a pro-rated refund for the unused portion. Monthly plans may be cancelled at any time and will remain active until the end of the current billing period.
5. Acceptable Use
You agree to use CredPing only for lawful purposes and in accordance with these Terms. You must not: upload fraudulent, forged, or intentionally misleading credential documents; attempt to circumvent, disable, or interfere with security features of the Service; use the Service for any illegal purpose or in violation of any applicable law; share your account credentials with others or allow multiple individuals to use a single account; reverse-engineer, decompile, or disassemble any part of the Service; use automated tools, bots, or scrapers to access the Service without our written permission; or impersonate another person or organization. Violation of these terms may result in immediate account suspension or termination.
6. Credential Data
CredPing is a credential tracking tool, not a verification authority. We do not validate, verify, or guarantee the authenticity of any credential documents uploaded to the platform. Users are solely responsible for the accuracy and legitimacy of the credential information they provide. The Traffic Light status system (green, amber, red) is based entirely on expiry dates entered by users and does not constitute a professional assessment of credential validity. Third parties viewing Live Badges should conduct their own independent verification of credentials where required by law or contract.
7. Intellectual Property
CredPing and its original content, features, and functionality are owned by CredPing and are protected by Canadian and international copyright, trademark, and other intellectual property laws. Our name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CredPing. You retain full ownership of all content you upload to the Service, including credential documents, images, and organizational data. By uploading content, you grant CredPing a limited, non-exclusive, non-transferable licence to store, process, and display that content solely for the purpose of providing the Service to you and authorized members of your organization.
8. Data and Privacy
Your use of CredPing is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. We handle all personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Canadian privacy legislation. By using the Service, you consent to the data practices described in our Privacy Policy.
9. Limitation of Liability
The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. CredPing does not warrant that the Service will be uninterrupted, error-free, or secure at all times.
To the maximum extent permitted by applicable law, CredPing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: consequences of credential expiry that were not acted upon in time, business decisions made based on the platform’s status indicators, data loss beyond our reasonable control, or service interruptions caused by third-party service outages. Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the total fees you paid to CredPing in the twelve (12) months preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless CredPing, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: your use of the Service, content you upload or share through the Service, your violation of these Terms, or your violation of any rights of another party.
11. Termination
Either party may terminate this agreement at any time. You may delete your account through your account settings. We may suspend or terminate your account immediately if you violate these Terms, with notice provided to you at the email address associated with your account. Upon termination, your data is retained for 30 days to allow for recovery or export, after which it is permanently and irreversibly deleted from our systems, including all uploaded credential documents. We recommend exporting any data you need before initiating account deletion.
12. Modifications to Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will provide at least 30 days’ notice via email to registered users and update the “Last updated” date at the top of this page. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and delete your account.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the Service shall be resolved exclusively in the courts located in the Province of Ontario, Canada, and you consent to the personal jurisdiction of such courts.
14. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
